South Dakota Governor Signs Antitransgender Bathroom Bill!

A new law in South Dakota, signed by Republican Gov. Larry Rhoden, will limit transgender individuals’ use of public school and state-owned building facilities starting July 1. The law, known as HB 1259, prohibits transgender people from using changing rooms and restrooms that correspond with their gender identity. It also allows individuals encountering transgender individuals in these facilities to seek legal recourse if officials fail to prevent their use of the facility.

Governor Rhoden stated that the law upholds common-sense values and combats what he refers to as the ‘woke’ agenda present in other areas. This marks the first time South Dakota has implemented a state law restricting transgender bathroom access due to the predominantly conservative state legislature.

The ACLU of South Dakota, represented by Samantha Chapman, is exploring options to challenge the law, describing it as painful and disheartening. South Dakota becomes the 13th state to enact legislation preventing transgender girls and women from using facilities corresponding to their gender in public schools and government buildings. Similar measures have been presented in Tennessee and Montana.

Despite facing legal challenges in several states, including Idaho, where a federal appeals panel recently allowed enforcement of a transgender bathroom ban, the fight for transgender rights continues. President Donald Trump’s executive orders aimed at restricting transgender rights have been countered by efforts from President Joe Biden’s administration to protect gender identity rights.
