Garland Ready to Release Trump Report Despite President-Elect’s Opposition!

“In a letter addressed to the top Republicans and Democrats on the House and Senate Judiciary Committees, Attorney General Garland announced the Department’s intention to provide Volume One of the Report to the public. Garland stated, ‘As stated in the Department’s filings in the Eleventh Circuit Court of Appeals today, when permitted to do so by the court, I intend to provide to you and to the public Volume One of the Report.’ Garland emphasized that the decision to release the materials is in compliance with applicable law and is in the interest of informing the public about the matter at hand.

The release of the report has been met with opposition from former President Trump, who has been attempting to block its release while making preparations to return to the White House on Jan. 20. However, judges have dismissed Trump’s cases following a request by Smith, citing the Justice Department’s policy against prosecuting a sitting president.

Trump, questioning the legitimacy of Smith’s appointment, sought to present an argument in the case, highlighting his perspective as a former and future president regarding the appointment of officials. Trump’s legal team expressed concerns that the report could potentially disrupt the transition of power and the effective vesting of executive authority.

Co-defendants Walt Nauta and Carlos De Oliveira also raised objections, fearing that the report could negatively impact any future trials they might face. U.S. District Judge Aileen Cannon, appointed by Trump, ruled that Smith’s appointment was illegitimate and temporarily blocked the release of the report pending further rulings from the appeals court.

While the release of Volume One has been approved, Garland decided not to make Volume Two public at this time due to the ongoing criminal proceedings involving Nauta and De Oliveira. Garland explained, ‘I have determined, at the recommendation of the Special Counsel, that Volume Two should not be made public so long as those defendants’ criminal proceedings are ongoing.’

The government lawyers argued that the report by Smith should not come as a surprise, as special counsels traditionally file reports outlining their investigations and decisions on charges. Examples cited include Robert Mueller’s investigation into Russian interference in the 2016 election, Robert Hur’s inquiry into President Joe Biden’s handling of classified documents, and John Durham’s review of the 2016 probe.

Despite Trump’s opposition and efforts to halt the report’s release, Garland plans to provide access to the report to the top members of the House and Senate Judiciary Committees. However, there are concerns that even a limited release of the report could impact the criminal cases involving Nauta and De Oliveira.
