Judge Hellerstein, appointed by President Bill Clinton, issued an order on Tuesday preventing the men’s removal from New York unless directed otherwise by the court. The ACLU is seeking a temporary restraining order that would shield any immigrant in detention at risk of deportation under the Alien Enemies Act. They argue that the law was misapplied by the Trump administration to target a criminal group rather than a state entity and was invoked without a war or invasion scenario.
