Khankhanian admitted to investigators that he had consumed alcohol and pills before driving, following his recent termination from his job and leaving a suicide note. His former attorney argued that Khankhanian’s psychological conditions, including autism, hindered his ability to foresee the consequences of his reckless driving.
The Shane family, who lost their daughter Emily in the tragic incident, expressed doubts about Khankhanian’s sincerity when he apologized before his sentencing. They believe he has been manipulating his autism diagnosis to benefit himself. Despite their desire for a longer sentence, they fear that Khankhanian may be released early if the ruling is overturned.

It brings us back to the death of a 13-year-old. Even though we now see her friends as 27, 28-year-old young women, in our minds, our child remains stuck at 13. It’s brutal because we have to relive it and then debate why the man who took a child’s life should be allowed out.”
“Frankly – and Ellen is much more forgiving than I am – I couldn’t care less; as far as I’m concerned, he could remain in jail. But if he must be released, he shouldn’t be set free as a 40-year-old with his entire youth ahead of him. Wait until he’s 60, wait until he’s 55 so that the majority of his youth is lost.”
Currently, they are hopeful that Newsom will take action and are striving to raise awareness, urging others to write to the governor. Although they have received support from lawmakers such as state Sens. Ben Allen and Henry Stern, they have not yet heard from Newsom regarding a potential parole reversal.
Khankhanian was granted suitability for parole on Oct. 22 following a hearing. Newsom’s office has stated that the decision is subject to review by the board’s legal office. “If the board’s decision becomes final within 120 days after the parole hearing, it is then subject to review by the governor,” a spokesperson from Newsom’s office told Fox News Digital. “The Governor’s Office has not yet received Khankhanian’s case from the Board of Parole Hearings. If it does, it will be carefully reviewed.”
In his 2023 decision to reverse the parole, Newsom stated that the evidence indicated Khankhanian posed “an unreasonable danger to society if released from prison.” Newsom acknowledged Khankhanian’s efforts to better himself in prison through self-help programs, college courses, and work as a teacher’s aide. However, he highlighted Khankhanian’s inconsistent compliance with treatment over recent years at the California Substance Abuse Treatment Facility and State Prison in Corcoran, Kings County.
