LAS VEGAS (AP) — The sole suspect in the 1990s murder case of iconic rapper Tupac Shakur has seen his bid to have the charges against him dismissed fall short. Duane “Keffe D” Davis, the accused, faced a setback as Clark County District Court Judge Carli Kierny ruled against his plea on Tuesday.
Judge Kierny made it clear from the bench that Davis’s claims of immunity deals struck with federal and local authorities back in his California days lacked substantial evidence to shield him from prosecution. The defense team, led by attorney Carl Arnold, argued vehemently that Davis should not have been indicted for murder due to these purported agreements. Arnold further contended that the 27-year delay in bringing charges against his 61-year-old client infringed upon Davis’s constitutional rights. However, Judge Kierny found no deliberate wrongdoing in the extended timeline of the case.
In the aftermath of the ruling, Arnold expressed the possibility of taking the decision to the state Supreme Court, a move that could potentially delay Davis’s upcoming trial in Las Vegas scheduled for March 17. Despite maintaining his plea of not guilty to first-degree murder, Davis remains in custody in Las Vegas as the legal battle unfolds.
Prosecutors have emphasized the strength of the evidence against Davis, pointing to his own admissions detailed in a tell-all memoir recounting the 1996 shooting. The incident, which led to Shakur’s tragic demise following a casino altercation involving the rapper and Davis’s nephew, Orlando “Baby Lane” Anderson, is at the heart of the case. Davis, a former gang leader hailing from Compton, California, stands accused of orchestrating the fatal shooting near the bustling Las Vegas Strip.
Davis’s arrest in September 2023, almost three decades after the fateful event that shook the world of hip-hop, marked a turning point in the unsolved mystery surrounding Shakur’s murder. In his own words and in his 2019 memoir chronicling his past involvement with a Crips gang faction in Compton, Davis detailed his role in the tragic night, alleging that he provided the firearm used in the attack.
As the last remaining suspect in the case, Davis’s involvement has been scrutinized in light of Anderson’s denial of any part in the shooting prior to his passing in 1998. The two other individuals present in the vehicle with Anderson and Davis at the time of the shooting have also since passed away, leaving Davis as the focal point of the legal proceedings.
